Terms of Service

1. Agreement to Terms

By accessing and using the services of Academy Insidergenie ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Services Provided

Academy Insidergenie provides construction services including:

• Custom home construction
• Home renovations and extensions
• Design consultation services
• Project management
• Construction planning and permits

3. Contracts and Agreements

All construction work is governed by separate written contracts that specify:

• Scope of work and specifications
• Timeline and milestones
• Payment terms and schedule
• Materials and labor costs
• Warranty and guarantee terms

These Terms of Service supplement but do not replace individual project contracts.

4. Payment Terms

Unless otherwise specified in your project contract:

• Initial deposit required before work commences
• Progress payments due at specified milestones
• Final payment due upon project completion
• Late payment fees may apply after 30 days
• All prices include GST where applicable

5. Changes and Variations

Any changes to the agreed scope of work must be:

• Requested in writing
• Approved by both parties
• Accompanied by revised cost estimates
• Documented in a variation order

Additional costs for variations are the responsibility of the Client.

6. Warranties and Guarantees

We provide the following warranties:

• Structural work: 6 years (as per Australian Consumer Law)
• Non-structural work: 2 years
• Defects and maintenance: 12 months
• Materials: As per manufacturer warranties

Warranties do not cover normal wear and tear, misuse, or lack of maintenance.

7. Limitations of Liability

Our liability is limited to:

• The total contract value for the specific project
• Direct damages only (no consequential damages)
• Claims must be made within warranty periods
• Exclusions as permitted by Australian Consumer Law

8. Force Majeure

We are not liable for delays or non-performance due to:

• Natural disasters or extreme weather
• Government restrictions or permit delays
• Material shortages or supply chain disruptions
• Labor disputes or strikes
• Other circumstances beyond our reasonable control

9. Intellectual Property

Unless otherwise agreed:

• We retain rights to our construction methods and processes
• Clients own their specific design plans upon full payment
• We may use project photos for marketing purposes
• Third-party materials remain property of their owners

10. Termination

Either party may terminate a contract:

• For material breach with 14 days written notice
• For convenience with 30 days written notice
• Immediately for safety concerns or illegal activity

Termination fees and outstanding payments will apply as per individual contracts.

11. Dispute Resolution

Any disputes will be resolved through:

1. Good faith negotiation between parties
2. Mediation through an agreed mediator
3. Arbitration if mediation fails
4. Victorian courts as a last resort

12. Governing Law

These terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the jurisdiction of Victorian courts.
